We have powers to prevent a 'statutory noise nuisance'. (Environmental Protection Act 1990)
We will track the situation and decide if a statutory noise nuisance exists.
If necessary we can serve an abatement notice. Not complying with this notice is an offence, punishable by a fine of up to £20,000 in the Magistrates Court.
Your details will be private if you make a formal complaint to Environmental Health. You might have to attend court if legal action happens. You will give evidence based on the completed diary sheets. This will support the case and you will not be able remain anonymous.
A licensee risks revocation of their personal licence/premise licence if convicted.
To help us resolve the problem, you should consider the following approach:
- be prepared to listen to their reply - try to understand their point of view
- always treat the other person with the same respect that you would like them to show you
- find areas of agreement - use them as a basis for a workable solution
